Can I break My Lease If the agreement has changed?
We live i a Non smoking 5 story Apartment building. The Lease says it is non smoking inside and you have to be 10 feet from the building. The Manager told us at lease signing, no smoking on the balcony, they are only 2- 5 feet out. The manager has rented the apartment below us and they smoke on their balcony, the smoke rises and enters our apartment as we leave the window and balcony door open in this nice weather. We also have noticed other people smoking on their balcony’s. The manager now says it is permissible to smoke on the balcony’s. We can’t stand tobacco smoke! We think she has changed the rules to get the place filled up. She also now allows charcoal grills which are also not allowed in the lease. We are sick of the changing rules and lies! Do we have a good reason to break the lease?
The lease states: Non Smoking Building! Must be 10 ft from building to smoke!
The lease states: NO charcoal grills!
Depends on what state you are in and the wording in the lease. Does the lease state these none smoking rules. If yes you might be able to get out of it.
If the lease states nothing about these no smoking rules, then the lease agreement is not being broken.
Update:
Do you have a copy of a new lease where the no smoking statement have been removed. You will probably need one that way you can show your lease that states no smoking and a newer lease for someone else with no comments about smoking in the building
Other wise the manager can just say he did not know about the people smoking and all the leases are the same.
